European Account Preservation Order now introduced in Greek Code of Civil Procedure

The Greek Code of Civil Procedure has recently introduced specific provisions that incorporate into Greek judicial system the requirements of European Union Regulation 655/2014 establishing the “European Account Preservation Order” (hereinafter as “EAP Order”).

By Article 738 A of the Code of Civil Procedure, the issue of the EAP Order has been made a type of judicial provisional measures, in order to facilitate cross-border debt recovery in civil and commercial matters. The procedure for the issue of the EAP Order is analyzed in EU Regulation 655/2014, and, since its characteristics are, in several crucial aspects, similar to the characteristics of the procedure for the issue of a court order for payment in accordance with  articles 623 ff. of the Code of Civil Procedure (also being the court order described as “equivalent national order” in R655/2014 EU), it is expected that Greek jurisprudence on the EAP Order will be based and will follow the principles of existent and current jurisprudence on the court order for payment.

Parental Responsibility and Custody

Parental responsibility and custody of a minor child is a right as well as an obligation of the parents, awarded at the child’s birth. What happens, though, in case of disputes and/or divorce? This subject is presented mainly according to the Greek and also international legislation, focusing on subjects such as: how parental responsibility is determined and awarded, which factors are to be taken into account for allocation of custody and exercise of parental responsibility, what happens in case of departure of the child from its permanent or temporary residence, abduction of the minor child and, finally what are the rights of the parent not exercising custody on the minor child, including issues on communication and illegal retention of the child.

E- Commerce

In the present analysis is provided information on the current legal framework governing e – transactions in Greece. Any interested party will be briefed on the basic regulations, the mandatory provision of information to the customer, the general terms of agreement in consumer transactions, the liability exclusion clauses as well as consumers’ right of cancellation withdrawal.

Privatizations are one of the obligations that the Greek State has assumed for international beneficial exploitation of its assets. The revenue of the above will contribute to decrease of the State’s international debt. This Article provides information on the relavant legislation, despite the overregulation existing in Greek Law, the assets eligible for privatization, as well as the tendering procedure until the final approval of the procedure’s outcome.

Interim Remedies and Precautionary Measures under Greek Civil Procedural Law

Filing a lawsuit in order to resolve a dispute does not generally provide in itself any protection to the parties’ rights until the examination of the case and the final Court judgment. In order to maintain and regulate the legal relationship or a factual or legal situation before the final judgement of the Court, the Greek Code of Civil Procedure, in Articles 682 – 738, has set the key provisions for precautionary measures and interim remedies.
